Terms and conditions
Definitions
Contractor: means Potential Electrical Australia
Customer: means the person/s placing the order for Works and/or products.
Quote: means any document containing a price for Works, including but not limited to Tax Invoices, quotations generated by computer or tablet devices or handwritten quotations.
Trading Hours
- The Contractor’s normal trading hours are 8am to 4.30pm Monday to Friday. Work performed (at the Customer’s request) outside those hours or on a public holiday will be at the Contractor’s discretion and will be subject to a surcharge.
Pricing
- If there is any error or omission or revision in the quote, Potential Electrical Australia reserves the right to change the contract sum on the quote. This clause applies even if the quote has been accepted by the customer. Prices quotes are subject to final costing assessment by Potential Electrical Australia.
- Upon accepting a quote from Potential Electrical Australia you agree to all the terms and conditions.
- Potential Electrical Australia may require a deposit to be paid prior to any Works being commenced. This deposit is at the sole discretion of Potential Electrical Australia.

Payment terms will be will be on the invoice, strictly 7 days unless otherwise agreed upon in writing. Any late payments from the customer later than 30 days may be passed on to a debt collection agency. Any fees or cost incurred from the debt collection agency for the debt will be passed on to the customer.
Additional works

Any additional work required due to no fault of the contractor will require a variation to the quote supplied to the customer. If the additional works are due to unsafe conditions the contractor will make safe at a cost to the customer, which may mean a loss of supply to the certain areas/ or all of the premises. The contractor will not be held responsible for any loss of income or loss of use to the premises.
VARIATIONS
- A Customer seeking a variation to the quote shall notify the Contractor in writing, setting out in full the details of the required changes to the works. A new quote may be required and agreed to before any variation works can be performed.
Cancellation
- The Customer shall reimburse the Contractor for any costs, losses or expenses incurred by the Contractor should the Customer cancel an accepted quote. The time for payment of such cancellation shall be seven (7) days from the date of the Contractor’s tax invoice.
Hazardous Materials:
- Unless specifically stated in this quote, the quoted price is based on the assumption that the work for which this quotation is submitted will be executed in a hazardous material free environment. It is a strict condition of this quotation that the customer accepts full responsibility for the resolution of any problems and for delays and additional costs which may result from the presence of these materials in or about the site on which the works (or any part thereof) are to be performed.
Live Work Clause
- It is our strict policy to only undertake live work or work near live conductors where it is safe to do so, particular emphasis is placed on: Compliance with AS/NZS 4836:2001 “Safe working on Low Voltage Electrical Installations, relevant Commonwealth and State Statutory Acts and Work Place Regulations”. Our live work procedure is designed to eliminate risk of injury to our employees, damage to your installations and unexpected power disconnections. The above may require us to disconnect or isolate parts of the installation to undertake such work for which additional charges may be applicable.
Work Site Access
We have based our quote on free and unrestricted access to all required work areas.

Clearing and / or moving of furniture and other items blocking access to work areas are not included.

Except where detailed, builders work (creating of holes larger than 50mm diameter, creating of support structures, etc) are not included.

Re-decoration and final making good is excluded from quoted costs, unless specifically detailed as included.

Removal from site and disposal of rubble, fittings, wiring, materials, general waste and packaging is not included.
Risk and Title of Goods and Property

The risk in all goods supplied shall pass to the Client upon delivery.

All goods supplied shall remain property of Potential Electrical Australia. until all sums due have been paid in full.

The client is responsible for ensuring that the property is insured for the duration of the installation work.
Warrantee

Potential Electrical Australia warrants its installation work to be defect free for a period of twelve months from invoice date. Such cover does not extend to goods not supplied by Potential Electrical Australia, physical damage to products, or any instance where the original installation has been altered or tampered with subsequently by third parties.
Amendments to Terms and conditions
The Contractor reserves the right to vary these Terms and Conditions at any time with notice in writing to the Customer. Any subsequent signed quote or work order will represent the Customer’s agreement to these Terms and Conditions as amended.
